The present Petition has been filed for quashing and setting aside the impugned the order dated 9th April 2015 passed by the learned Additional Sessions Judge, Satara in Criminal Revision Application No.31 of 2015 and for discharge of the Petitioner in C.R. No.3 of 2015 registered with Khandala Police Station, District Satara and for other consequential reliefs.

Mr. Gavankar, learned counsel for the Petitioner submits that due to passage of time the Petition has become infructuous as far as prayer clause (a) of the present Petition is concerned. As far as prayer clause (d) i.e. seeking discharge from C.R. No.3 of 2015 is concerned, he seeks liberty to file a discharge application before the Trial Court after the investigation is complete and the charge-sheet is filed. He, therefore, seeks liberty of this Court to withdraw the Petition, with
PNP 2/2 WP1472-30.6 leave to file a discharge application.

In view of the above, the present Petition is allowed to be withdrawn as has become infructuous with respect to prayer clause (a).
Leave is granted to the Petitioner to file discharge application before the Trial Court, if so advised, after the charge-sheet is filed. The Petition is disposed of in the aforesaid terms. (A.S. Gadkari, J.)
