The above Civil Application has been filed by the Applicant seeking his impleadment in the above Writ Petition which challenges the order passed by the Divisional Joint Registrar, Cooperative Societies, Kolhapur Division, Kolhapur by which order the Divisional Joint Registrar has rejected the Revision on the ground that there is no compliance of Section 154 (2A) of the Maharashtra Cooperative Societies Act. The said Revision has been filed against the certificate issued under Section 101 of the said Act. The Applicant claims to be an auction purchaser in the auction held pursuant to Section 101 Certificate which was issued in favour of the Respondent No.4 and therefore seeks his impleadment in the above Writ Petition. lgc
caw1446.15 The learned counsel appearing on behalf of the original Petitioner Shri P D Dalvi though opposes the application, ultimately leaves it to the Court. In my view, though the Applicant may not be a necessary party, he is a proper party to the above Writ Petition having regard to the challenge raised therein. Hence the above Civil Application is accordingly allowed. Resultantly the Applicant is allowed to be impleaded as a party Respondent to the above Writ Petition. Amendment to be carried out within two weeks from date. List the Petition for admission on 09/09/2015. The above Civil Application is accordingly disposed of.
