IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION REVIEW PETITION (ST) NO. 10319 OF 2018 IN PUBLIC INTEREST LITIGATION NO. 194 OF 2016 Dattaram Vishram Shinde ... Petitioner Vs 1 Maharashtra Maritime Board & Ors.

... Respondents Mr. Surel S. Shah for the Petitioner.

Mrs. Reena A. Salunkhe, AGP, for the Respondent-State. CORAM : S.C. DHARMADHIKARI & N.M. JAMDAR , JJ.

THURSDAY, 25TH JULY, 2019 P.C. :

We have heard Mr. Surel Shah appearing on behalf of the Review Petitioners. With his assistance, we have perused the order under review. The order under review was passed while deciding a Public Interest Litigation. This Court came to a clear conclusion that far from espousing a cause in public interest, the cause espoused is purely in private interest and even that was suppressed from this Court. The two orders passed on the Public Interest Litigation of 15th September, 2017 and 6th October, 2017, SRP 1/2

903-RPWST10319.18.doc contain sufficient reasons for imposing costs. We do not think that, that part of the order by which costs of Rs.5,00,000/- have been imposed should be re-visited by us for what is clear to us is an attempt to seek a review of the entire order in the garb of sympathetically considering the request to delete the direction to pay costs. Once we see this attempt, all the more we are not inclined to entertain the Review Petition. It is dismissed.
