It would be open for the Petitioner to avail of alternate remedy of an Appeal for objecting the decision rendered by the Sub-Divisional Officer, Miraj on 29.08.2016. It would also be open for the Petitioner to raise the contentions as regards the applicability of the Government Resolution dated 30.07.2010 to the Respondent No.4-Darga. If the Appellant tenders an Appeal within six weeks from today, the Appellate Forum while considering the application seeking condonation of delay in presenting the Appeal shall have due regard to the aspect of time spent in prosecuting remedy of writ petition before this Court.

In view of the above, both the Writ Petitions stand disposed of with liberty as above.
