The Applicant herein has sought modification of condition as enumerated in paragraph 4(ii) of order dated 26/03/2018 passed by this Court (Coram : P.N. Deshmukh, J.) in Bail Application No.1089 of 2017.

While releasing the Applicant on bail, this Court had directed the Applicant not to enter the limits of Chandgad Police Station except for attending the Court hearings. Considerable time has lapsed since the Applicant has been released on bail. It is stated that vide letter dated 10/03/2021, the Divisional Assistant Director, Higher Education, 1/2

P.H. Jayani 27 IA1287.2021.doc Kolhapur has directed the College/Educational Institute, Kolhapur to re-instate the Applicant in the service. The college is within the limits of Chandgad Police Station. In view of the condition enumerated in paragraph 4(ii) of the order dated 26/03/2018, the Applicant will not be able to join the college. Hence, in the interest of justice, the said condition needs to be relaxed.

It is also seen that since condition was imposed on the Applicant not to enter the limits of Chandgad Police Station, vide clause 4(iii) of the order, he was ordered to attend Shahu Police Station on the first day of each month initially for a period of six months, and thereafter quarterly on the first day of such months, pending the trial. This clause also needs to be modified in view of relaxation of clause 4(ii) of the order. Accordingly, clause 4(ii) of the order dated 26/03/2018 is relaxed and clause 4(iii) is modified to the extent that the Applicant is directed to appear before Chandgad Police Station on the day and for the period specified in the said clause.
