P.C.:- 1) By this Petition, the Petitioner seeks a direction to take cognizance/action against the Respondent Nos.1 to 3 on the basis of Petitioner's complaint dated 14th March 2022. 2) Learned APP raises a preliminary objection. He states that the complaint has been made against the Police officers and hence, the Petitioner has an alternate efficacious remedy of filing the complaint before the Divisional Police Complaints Authority or the State Police Complaints Authority, as the case may be.

3) In view of the objection raised by the learned APP, learned counsel for the Petitioner does not press the Petition and seeks leave to Shivgan 1/2

33-wp-2619-2022.doc withdraw the same with liberty to file appropriate complaint before the Divisional Police Complaints Authority or the State Police Complaints Authority, as the case may be. If the said complaint is made, the said Authority to decide the same expeditiously. 4) With the aforesaid observations, the Petition is disposed off as withdrawn with liberty as prayed for.

5) We make it clear that we have not heard the Petition on merits vis-a-vis the allegations made by the Petitioner against the Respondent No.1 i.e. Senior Inspector of Police attached to Mangalvedha Police Station, Solapur and as such, all contentions of all the parties are kept open.
