A praecipe is moved for speaking to minutes of the order dated 1st February, 2021 passed in this appeal. 2.

Learned Counsel for the appellant submits that while permitting to withdraw the appeal, liberty was granted to file a fresh suit. According to him, liberty ought to have been granted to file an application as per section 8 of the Hindu Minority and Guardianship Act, 1956.

In view of the submission of the learned Counsel for the appellant, the words in paragraph 1 of the aforesaid order; "with liberty to file a fresh suit" are substituted with the words "with liberty to file an application".

After paragraph 2, following para be added, "In view of disposal of the appeal, pending application, if any, shall stand disposed of".

The order dated 1st February, 2021 stands corrected accordingly. Rest of the order remains as it is. 6.

After carrying out the necessary correction, corrected order be uploaded on the website of this Court.
