The applicant is seeking anticipatory bail in connection with C.R.No. 05/2019 registered with Aundh Police Station under Sections 420 and 473 of the IPC.

The FIR is lodged on 10th January 2019 by one Balaso Dubal. It is mentioned in this FIR that he was working as a driver. He was concerned about his son Aniket, who was searching for a job. The informant's brotherinlaw came in contact with the present applicant. The present applicant met the informant. The applicant demanded money to be paid to the officers for securing a job for the informant's Nikita Gadgil
2 20-ABA-803-19 .doc son in the corporation. He had sent a copy of the appointment letter in respect of post of supervisor in the corporation on the mobile phone. On this pretext he obtained almost Rs. 3 lacs from the first informant from time to time. The applicant never intended to give any such job and thus informant was cheated by the applicant and no job was given to his son.

Heard Mr. Gawade, learned counsel for the applicant and learned APP Mr. Yadav for the State.

Learned counsel for the applicant submitted that the applicant is falsely implicated in this crime.

The allegations in the FIR clearly made out a case that right from the begining, the applicant had intention to deprive the first informant of his hard earned money and on the false pretext of giving job to his son, sent a copy of fake appointment letter. All these allegations point out that the offence is committed. Custodial interrogation of the applicant is necessary in this case. Hence, there is no merit in the case. Application is dismissed.
