Heard learned counsel for the applicant.

Learned APP for the State as well as learned counsel for the victim are present and opposed the bail application. 3.

It is now reported that supplementary charge-sheet is filed as the other accused person is shown as absconding. 4.

The present applicant was arrested somewhere in the month of February 2023, though registration of offence is somewhere in the year 2020.

Learned counsel for the applicant submits that in view of filing of supplementary charge-sheet, applicant be permitted to withdraw the present application with liberty to approach the trial Court by filing fresh bail application.

The fact that since supplementary charge-sheet is filed, the applicant could be permitted to withdraw the present application with liberty to approach the trial Court with a fresh bail application. If such application is filed, it shall be considered and decided on its own merit without being influenced by the earlier order and changed circumstances.

It is made clear that this Court has not gone into the merits as well as grounds raised in the present application. All contentions of the parties are kept open.

Accordingly, Bail Application stands disposed of as withdrawn with liberty as prayed for.
