1] By the present petition under Article 227 of the Constitution of India, the Petitioner - original landlord has taken exception to the judgment and order dated 09/08/1995 passed by the learned Member of Maharashtra Revenue Tribunal, Pune, thereby confirming the Judgment and Order dated 03/08/1991 passed by the Sub­Divisional Officer, Pandharpur Division, remanding the application of the respondents to the Tahsildar for fresh enquiry and necessary action, as per the provisions of Section 32(k) of the Bombay Tenancy and Agricultural Lands Act.

osk 210­wp­2086­1996.odt 2] At the outset, it is to be noted hear that a minute perusal of the impugned judgment and order passed by the Tribunal indicates that the Tribunal has not committed any error either in law or on facts. It further appears that, the order passed by the Tribunal has been worked out and due to efflux of time, the present petition has become infructuous.

3] Petition is accordingly dismissed.
