IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.10791 OF 2018 Dinesh Dnyandev Bandgar .... Petitioner Vs.
The Education Officer (Secondary), Zilla Parishad, Solapur & Others .... Respondents Mr. Ashok B. Tajane for the Petitioner.
Mr. M.M. Pable, AGP, for the Respondent-State. Smt. Sudha Salunke, Deputy Education Officer (Secondary), Solapur, present.
CORAM: S.C. DHARMADHIKARI & R.I. CHAGLA, JJ.
DATE : NOVEMBER 11, 2019 P.C:
1.
The Deputy Education Officer (Secondary), Zilla Parishad, Solapur, is present in the Court.
2.
It is reported that the Education Officer (Secondary) of this Zilla Parishad is on a planned leave. 3.
We do not understand what this phrase or words mean but this Education Officer must report for duty on 14-11-2019 at 10:30 a.m..
4.
After reporting for duty, within four (4) weeks he should pass orders on the pending proposal seeking approval
suresh 2-WP-10791.2018.doc to the petitioner's appointment.
5.
We have not said that a particular order should be passed by this Officer. All that we expect him to do is to dispose of the pending application for approval. Anybody who comes to Court and obtains an order and direction like this, achieves his/ her purpose by then getting his/her application or proposal decided out of turn. The rest have to wait for their turn and most of them may not be able to afford approaching this Court. 6.
It is in these circumstances, we impress upon the Education Officers not to take unnecessary leave when several files and proposals are pending and crying for their attention. 7.
The writ petition is disposed of by accepting the statement of the learned AGP, that the pending proposal shall be disposed of within four (4) weeks from today, as an undertaking to this Court.
