In anticipation of arrest, the applicant is seeking pre-arrest protection in Crime No.33 of 2022 registered with MIDC Police Station for the offences punishable under Sections 365, 323, 504, 506 r/w 34 of the Indian Penal Code.

The State opposed bail by contending that the applicant's direct role is evident from the FIR itself. It is submitted that since the informant has sustained injury of grievous nature, police have added Section 367 of the IPC. Considering the seriousness, the bail is prayed to be rejected.

It is the prosecution case that on the date of occurrence the applicant was abducted by all three accused (including applicant) and took him on motor-cycle to secluded place. They have beaten informant by means of fist blows and kicks at the instance of love affair. Though informant stated that applicant also beated him,

Priya Soparkar 2 6 aba 1116-22-cr however the main allegation of thrashing head on the wall was against co-accused Kedar Mangarulkar.

It reveals that one of the co-accused was having love affair with a girl. Since informant was in contact with said girl, all three boys took him at secluded place and asked him to deter for such act. 5.

Considering the nature of accusation, there is no chances repetition nor there are criminal antecedents against the applicant. Nothing is to be seized at the instance of applicant. In view of that, his liberty can be protected by directing him join the course of investigation. Hence, following order:- (a) The Application stands allowed.

(b) In the event of arrest, the Applicant/Accused namely - Mr.Rishikesh @ Rushi Manoj Pangavkar in Crime No.33 of 2022 registered with MIDC Police Station for the offences punishable under Sections 365, 323, 504, 506 r/w 34 of the Indian Penal Code, he be released on bail on his furnishing P.R. bond of Rs.25,000/- with one or two sureties in the like amount.

(c) The applicant shall attend the concerned Police Station on every Sunday and Wednesday in between 10.00 a.m. to 12.00 noon to facilitate the investigation till filing of charge sheet.

(d) The applicant/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the prosecution evidence. (e) The application stands disposed in above terms. (VINAY JOSHI, J.) ....
