The learned Counsel for the Appellant states that in view of the Bombay amendment to Rule 1 of Order 43 of the Civil Procedure Code, an "appeal from order" would lie against the order dated 29.1.204. It is stated that the appellant is desirous of filing the Appeal from Order and this Court may permit the appellant to withdraw the appeal with liberty to file an appeal from order.

Permission and liberty, both granted as prayed for. First appeal is disposed of as withdrawn.
