The Appellant and Respondent No.2 filed a Suit against the Respondents which was decreed. Thereafter the Respondent No.1 filed an Appeal in the District Court Kolhapur. The Appellant as well as Respondent No.2 also filed the Appeal. The Appeal filed by the Respondent No.1 was allowed and the Appeal filed by the Appellant and Respondent No.2 was dismissed.

The present Second Appeal No.207 of 1994 is dismissed as abated against Respondent No.1 by order dated 18 August 1995 and by order

2 215 & 216 SA 207 and 208-1994.doc dated 22 December 1995 Second Appeal No.208 of 1994 is dismissed against the Respondent No.1. No steps are taken to bring heirs of the sole Defendant on record. In the circumstances the Appeals are already abated and disposed of as such.
