At the outset, learned Counsel for the petitioner seeks leave to amend the prayer clause. Leave granted. Amendment to be carried out forthwith.

After arguing for sometime, learned Counsel for the petitioner does not press this petition and seeks leave to withdraw the same with liberty to pursue the application filed by the petitioner before the Wakodikar 1/2

18. WP 5377-2022.doc Respondent No.3 - District Co-operative Election Officer and District Deputy Registrar Co-operative Societies, Kolhapur. He submits that the Respondent No. 3 - District Co-operative Election Officer and District Deputy Registrar Co-operative Societies, Kolhapur be directed to decide the said application dated 13th April, 2022 filed by the petitioner, as expeditiously as possible and in a time-bound manner. 3.

Without going into the merits of the aforesaid petition and by keeping all contentions of all parties open, we direct the Respondent No. 3 - District Co-operative Election Officer and District Deputy Registrar Cooperative Societies, Kolhapur, to decide the said application of the petitioner dated 13th April, 2022, as expeditiously as possible, in accordance with law.

The petition is disposed of on the aforesaid terms. 5.

All contentions of all parties including the question of maintainability, are kept open.
