Heard Mr. Ajitkumar Shah, learned counsel for the appellant and Mr. Mahadev Chaudhari, learned counsel for respondent no.1.

Learned counsel appearing for the parties have tendered Consent Terms dated 27.3.2015 duly signed by the appellant and respondent no.1 as also their Advocates. Mr. Shah submits that the appellant is present in the Court. Mr. Chaudhari states that respondent no.1 is present in Court. They have tendered photocopies of Identity Card issued by Election Commission of India in favour of Appellant and Aadhar Card of respondent no.1. Mr. Shah states that respondents no.2,3 and 4 are formal parties and no reliefs are claimed by respondent no.1 - original plaintiff. Learned counsel appearing for the parties state that they have

2 / 2 SA/326/1993 explained and interpreted the contents of the Consent Terms in vernacular language to the parties. The parties admit and confirm the correctness of the Consent Terms. 3.

After perusing the Consent Terms and in particular paragraphs 2 to 5, I am satisfied that the controversy between the appellant and respondent no.1 is lawfully and amicably settled in terms of the Consent Terms. The Consent Terms are taken on record and marked "X" for identification. Photocopies of identity card and Aadhar Card are taken on record and marked "Y" collectively for identification.

Second Appeal is allowed in terms of the Consent Terms by substituting the decrees passed by the Courts below. Decree shall be drawn as per the Consent Terms.
