Heard. This Application is made by the Plaintiff for condonation of 33 days delay in filing the Second Appeal challenging the decree dated 30/11/2013 passed by the Appellate Court in Regular Civil Appeal No.220/2002.

The learned counsel for the Respondent Defendant vehemently opposed the Civil Application. He submits that the Applicant has not shown sufficient cause for condonation of 33 days delay in filing the Second Appeal. Hence, there is no substance in the Civil Application and same is required to be rejected.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Delay of 33 days in filing the Second Appeal is condoned.

b) Civil application stands disposed off accordingly.
