This is an application under Section 438 Cr.P.C. filed by the aforesaid applicants apprehending their arrest in C.R.No. 73 of 2018 registered with Malshiras Police Station, Solapur, for offences under Section 379 r/w. 34 of Indian Penal Code and Sectin 3 , 15 of Environment (Protection) Act and Section 21(4) of Mines and Minerals Act;

Heard Mr.Kakade, the learned Counsel for the applicant and
Shri Agarkar, the learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties .

The applicant was granted interim bail by order dated 17th April, 2018 and in the event of arrest was ordered to be released on bail on furnishing bail bond of Rs.25,000/ with one surety in the like amount. The applicant was also directed to report to the Investigating Officer.

The learned APP submits that the applicant is arrested and was released on bail as per the interim order. He further submitted that the applicant has already been interrogated and that his presence is no more required for the purpose of custodial interrogaton. He submits that the investigation is completed and chargesheet will be filed within one week.

Considering the above facts and circumstances, the application is allowed on following terms and conditions: (i) In the event of arrest of the applicant in Crime NoC.R.No. 73 of 2018 registered with Malshiras Police Station, Solapur, the applicant be released on bail on furnishing bail bond of Rs.25,000/ (Rupees
Twentyfive Thousand Only) with one or two solvent sureties in the like amount, to the satisfaction of the Investigation Officer. (ii) The applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer. (iii) The applicant shall not change his residential address without Prasanna Pradeep Salgaonkar prior intimation to the Investigation Officer.
