The Applicant happens to be the original complainant in Sessions Case No. 89 of 2014 decided by the Sessions Judge, Kolhapur vide judgment and order dated 31st August, 2015. 3.

It is submitted that on the basis of the complaint filed by Respondent No.1, the Applicant herein has been convicted for an offence punishable under section 302 of the Indian Penal Code and same is under challenge before the Division Bench. In view of this, the leave needs to be granted.

Accordingly the application seeking leave to appeal is allowed. Criminal appeal be heard along with Criminal Appeal No. 1024 of 2015.
