This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.208/2022 registered with Pandharpur Taluka Police Station, Solapur Rural for offences punishable under sections 354, 363, 366A r/w. 34 of the Indian Penal Code, sections 4,8,12,16 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 and sections 9 and 10 of Prohibition of Child Marriage Act.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.

The aforesaid crime was registered pursuant to the FIR lodged by 1/2

P.H. Jayani 20 ABA1218.2022.DOC the father of the victim. The case of the Complainant is that on 21/03/2022, his minor daughter has left the house with an assurance to return immediately. When she did not return, he lodged complaint against the unknown person for kidnapping his minor daughter. Subsequently, victim was traced. It was revealed that the victim girl and the co-accused Sachin Balasaheb Bhosale had gone to Mumbai and got married. Coaccused - Sachin was arrested and the custody of the victim was handed over to the parents. The allegations against the present Applicant are that he had assisted the co-accused in kidnapping the girl. He was the driver of the car which was used by the co-accused - Sachin to kidnap the girl. 4.

Considering the nature of accusations against the Applicant, this Court (Coram : Vinay Joshi, J.) had by order dated 04/05/2022, granted interim bail to the Applicant which is continued from time to time. Learned APP states that the investigation is completed and charge sheet has been filed.

Considering the above facts and circumstances, interim order dated 04/05/2022 stands confirmed.

Application stands disposed of.
