The civil application is taken out to restore the second appeal as against Respondent No.9. By an order dated 6 May 2014, learned counsel for the Respondent Nos.3 to 5 had taken time to file reply. Perused the application. For the reasons stated as of advanced age of the Applicant of 86 years and his health problems and appearance is already filed on behalf of Respondent No.9, the civil application is allowed in terms of prayer clauses (a) and (b).

The civil application is disposed of.
