In anticipation of arrest in C. R. No. 114 of 2022 registered with the Chandannagar Police Station, District - Pune City for the offences punishable under Sections 420, 406, 468, 471, 120B, 465, 466, 467 r/w 34 of the Indian Penal Code, the applicant is seeking pre-arrest bail. 2.

It is the prosecution case that the applicant alongwith her husband jointly applied to the State Bank of India for housing loan. The proposal was accepted and in turn housing loan of Rs. 54,00,000/- was disbursed to the Developer, who is also co-accused. Since loan account fails in arrears, Bank made enquiry on which it was revealed that the same applicant - lady alongwith her husband had earlier obtained loan of Rs. 49,00,000/- from the South Indian Bank and Rs. 54,00,000/- from the Bank of Maharashtra for same fat. Prima facie, it is evident that for same residential fat, false papers were prepared and by suppressing earlier transactions loan of Rs. 54,00,000/- has been obtained from the SBI in connivance with the Developer. Undisputedly, the applicant is one of the co-borrower meaning thereby is beneficiary. Apparently, it is the case of cheating, forgery and fraud which requires custodial interrogation. No case is made out for grant of pre-arrest bail. Hence, the application stands rejected.
