In the first session, after hearing the learned counsel for the Applicant for some time, the matter was kept back at the request of the learned counsel, enabling him to seek instructions from the Applicant, whether to proceed with the application on merit or to withdraw the same.
Later on, the learned counsel for the Applicant on instructions of the Applicant, who is present in the court, seeks permission to withdraw this application with liberty that the Applicant be granted time till Monday i.e. 23.04.2018 to surrender before the concerned Police. Learned counsel seeks such interim protection till Monday on the ground that the Borey 1/2
spb/ 906aba798-18.odt Applicant was initially protected by the learned Additional Sessions Judge, Gadhinglaj by order dated 23.02.2018. Record reveals that by order dated 23.02.2018, the applicant was granted interim protection till 20.03.2018 and on 20.03.2018, the said interim protection was vacated / rejected by the learned Additional Judge on the ground that the Applicant had failed to attend the Investigation Officer, as directed by the learned court. In the circumstances, the Applicant is allowed to withdraw this Application; however, further interim protection is granted to the Applicant till 23rd April, 2018 on which date he shall surrender before the concerned Police.
