Heard learned counsel for the Petitioner.

By this Petition, the Petitioner has impugned the order dated 18.02.2016 passed by the learned Civil Judge, Senior Division, Gadhinglaj, District - Kolhapur, by which the Petitioner's Application for temporary injunction under O. XXXIX, Rule 1 and 2 of the Code of Civil Procedure was rejected as well as the order dated 17.02.2017 passed by the learned District Judge - 1, Gadhinglaj, District - Kolhapur, by which the learned District Judge was pleased to confirm the order of the trial Court.

Having perused both the orders dated 18.02.2016 & 17.02.2017, no perversity or infirmity can be found in the said orders

WP 2033-18.doc warranting interference. Hence, the Petition is dismissed. However, the suit, being Special Civil Suit No. 6 of 2013 is expedited. The learned trial Judge is requested to dispose of the said suit expeditiously and preferably within sixteen months from the date of receipt of this order. 4.

Accordingly, the Petition is disposed of.
