The appeal was admitted on 22nd June 2021. We have, by a separate order passed today in Interim Application No. 891/2022, SQ Pathan 1/2

17-APEAL-491-2021.doc set-aside the impugned judgment and order of conviction and sentence dated 22nd April 2021 passed by the learned Additional Sessions Judge, Pandharpur vide Exhibit 96 in Sessions Case No. 34 of 2017, only to the extent that it records a conviction of the appellant/applicant and sentences the appellant/applicant for the same. We have, by the said order, remitted the case back to the trial Court, for recording crossexamination of PW 11 and for examination of defence witness of the appellant/applicant.

In view of the above, the Appeal stands disposed of. In view of the disposal of the appeal, nothing survives for consideration in Interim Application No. 1585/2021. The same stands disposed of accordingly.
