C.R. No. 84 of 2017 registered with Vairag Police Station, invoking Section 306 of the Indian Penal Code (IPC), is prayed to be quashed and set aside by the Applicant by stating that no offence under Section 306 of the IPC is made out against him.

We have heard the learned counsel for the Applicant and the learned A.P.P. for the State. The learned A.P.P. would submit that on completion of the investigation of the subject C.R., charge-sheet Chaitanya

2/2 14-Apl-500-2017.doc No.110/2019 has been filed in the Court of Judicial Magistrate First Class, Barshi.

In the wake of the aforesaid statement being made, since a challenge to the charge-sheet belatedly according to us would not serve any purpose, we permit the Applicant to withdraw the Application with liberty to file appropriate proceeding seeking discharge, as it is his specific case that no offence against the him under Section 306 of the IPC is made out.

Criminal Application stand disposed off.
