Buy this application, the applicant has challenged the judgment and order dated 16th January 2021 passed by Learned Additional Sessions Judge, Kolhapur in Criminal Appeal No.165 of 2018 thereby the Learned Additional Sessions Judge, Kolhapur has enhanced the maintenance amount at Rs. 2,500/- 2.

It is contention of learned counsel for the applicant that the applicant is more than 70 years old, the respondent had left the company of the applicant for last 35 years, before filing the

maintenance application. She was staying with her mother. The applicant has no source of income. The learned trial Court had granted Rs.1000/- per month as maintenance amount to the respondent. The said order was challenged before the learned Additional Sessions Judge, Kolhapur by the respondent for enhancement of the maintenance amount. Accordingly, the said appeal is allowed and maintenance amount is enhanced to Rs. 2,500/-per month. The said amount is enhanced without any reasonable grounds. Learned counsel for the applicant further submitted that the respondent is staying in the house of her mother. She has received amount from the agriculture land sold by her mother and in cross-examination she admitted the said fact. Hence, requested to allow the application and set aside the order passed by the learned Additional Sessions Judge, Kolhapur enhancing maintenance amount.

It is contention of learning counsel for the respondent that the respondent has no source of income. She stays alone. The learned Additional Sessions Judge, Kolhapur has passed well reasoned order. No interference is required in it and requested to reject the application.

I have heard both the learned counsel. Perused the impugned

judgment and order.

The respondent stays alone. It appears from the record that she has no source of income. He needs the amount for her daily expenses. In the present period, Rs.2,500/- is paltry amount. Considering this fact, I pass following order :

ORDER

The Revision Application is dismissed.
