The Trial Court by the order dated 30th September 2016 restrained the petitioners from disturbing joint possession of the plaintiffs/respondents over the suit property. The order of the Trial Court is in force since 30th September 2016. Hence, at this stage, no interference is called for.

However, the Trial Court shall decide the suit on its own merits uninfluenced by the observations made by the Courts below in the impugned judgment and orders.

3.

Hearing of the suit is expedited.
