None present for the applicant, when called out. Under the circumstances, the application is being decided after going through the same and after hearing the learned Additional Public Prosecutor.

The applicant's previous application for bail was rejected by me (Bail Application No.866 of 2014 decided on 16th June 2014). Now by this application, the prayer for bail is renewed.

A perusal of the application and more particularly, the grounds urged in support of the prayer for bail indicates that Gaikwad RD 1/2

903.BANo.9512015 nothing new has been mentioned in the application and the same contentions, as were raised in the previous application have been raised. In fact, curiously, reference is made not to the order passed by this Court rejecting the bail application, but to the order passed by the Court of Sessions rejecting the applicant's application for bail, which was done before this Court rejected the applicant's application for bail.

The only change in the circumstances, seems to be that the applicant has remained in custody for a period of about one year after the rejection of previous bail application. However, there is no assertion in the application as to the stage or state of the trial. There is no assertion that the trial has not commenced and if so, for what reason.

The applicant has not chosen to remain present through his counsel and throw light on these aspects; and/or to make submissions in support of the application. Under the circumstances, I am not inclined to grant bail. 6.

The application is rejected.
