The writ petition arises out of proceedings under Section 149 of the Maharashtra Land Revenue Code, 1966. On perusal of the record, it appears that Civil Suit No.224 of 2001 was instituted on behalf of the parties which was dismissed. However, appeal against the said decree is pending.

The rights of the parties shall be in accordance with final judgment passed in the said proceedings.

Clarifying the aforesaid position, the writ petition stands disposed of.
