IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.3003 OF 2019 VAIBHAV RAMESH JADHAV Raghunath Pandurang Patil & Ors.

... Petitioners V/s.

Suresh Bajrang Chougule ... Respondent VAIBHAV RAMESH JADHAV Date: 2024.12.06 16:47:12 +0530 Mr. Chetan G. Patil for the petitioners.

CORAM

: AMIT BORKAR, J.

DATED : DECEMBER 6, 2024 P.C.:

1.

The Appellate Court, by the impugned order, has allowed the respondent's application filed for condonation of delay of 35 days. According to the petitioners, the application did not contain the reasons. However, the Appellate Court, by the impugned order, has assigned plausible reasons for allowing the application for condonation of delay. The positive exercise of jurisdiction by the Appellate Court need not be interfered as, in my opinion, the approach of the Appellate Court cannot be termed as perverse. Hence, no interference is called for. The writ petition is dismissed. 2.

Pending interlocutory application(s), if any, stand disposed of.

(AMIT BORKAR, J.)
