The Petition essentially challenges the Notices dt. 12.3.2020 and 4.6.2020 issued by the Respondent No.1-Solapur Municipal Corporation under Section 478 of the Maharashtra Municipal Corporation Act calling upon the Petitioner to demolish the offending structure.

Learned Counsel for the Respondent No.1 Corporation states that the final orders are yet to be passed on the Notices and hearing has now been scheduled for tomorrow i.e. 26.10.2021.

In view of the above statement of learned Counsel for the Respondent-Corporation, learned Counsel for the Petitioner does not press the Petition and seeks leave to withdraw the same. 4.

The Petition is allowed to be withdrawn and to stand disposed of. All contentions are kept open.

We make it clear that the final order on the Notices shall be communicated to the Petitioner and no coercive steps shall be taken against the Petitioner for a period of three weeks from the date of receipt of communication of the final order.
