By this application the applicant is seeking transfer of H.M.P No. 34 of 2023 pending before the Civil Judge Senior Division, Mhada, Dist- Solapur to Civil Judge Senior Division, Indapur, Dist- Pune 2.

Learned counsel for the applicant submits that the Respondent stays at Indapur. Hence, the applicant wants to transfer the H.M.P. to Indapur where the H.M.P. filed by the Respondent is pending.

Learned counsel for the Respondent strongly objected for transfer of the H.M.P. on the ground that arrears of maintenance has not been deposited by the Applicant.

Learned counsel for the Applicant, on instructions, submits that the Applicant will deposit 50% amount out of the arrears of maintenance amount within a period of three weeks from today.

Considering the submissions of both the learned counsel, as well as the applicant want to transfer the H.M.P. at the place where the Respondent stays and her Cri. Misc. Application is pending.

Considering these facts, I pass the following order. I.

Application is allowed.

II.

H.M.P. No.34 of 2023 pending before the Civil Judge Senior Division, At Madha, Solapur be transferred to Civil Judge, Senior Division, at Indapur, DistrictPune. III.

Both parties to appear before the Civil Judge, Senior Division, Indapur, District-Pune.

IV.

The applicant shall deposit the 50% of the arrears 2/3

amount within a period of three weeks from today before the Judicial Magistrate First Class at Indhapur District-Pune.

V.

Civil Judge, Senior Division, Indapur, District-Pune is requested to dispose of the pending H.M.P. as early as possible.

Application stands disposed of.
