CRIMINAL APPELLATE JURISDICTION CRIMINAL BAIL APPLICATION NO.967 OF 2015 Ramashish Ramjatan Yadav ...

Applicant Vs.

The State of Maharashtra ...

Respondent None for the applicant.

Mrs. Veera Shinde, APP for the State.

CORAM : SMT ANUJA PRABHUDESSAI, J.

DATE : 23 rd February, 2016.

P.C. :

1.

This is an application received through jail from the aforesaid applicant, who is facing trial in Sessions Case No.26 of 2014 pending on the file of 3rd Addl. Sessions Judge, Satara. 2.

The status report received from Addl. Sessions Judge, Satar reveals that the case is being adjourned time and again as the defence lawyer as well as accused are not cooperating. The report further indicates that the applicant herein has filed four applications for bail and on account of constant filing of such application it is difficult to take preliminary hearing and to frame the charge. Considering the fact that the applicant is himself responsible for delaying trial, I am not inclined to give any direction to the Addl. Sessions Judge, Satara

jsn 10 BA No.967_2015 to dispose of the case in time bound frame. Nonetheless considering that the applicant is in custody the learned Addl. Sessions Judge, Satara to make every possible endeavour to dispose of the case as expeditiously as possible.

3.

The application stands disposed of in view of the above observations.
