Heard learned Counsel for the parties.

This Application is preferred by the defendant no.1 for bringing legal heirs on record of deceased respondent no.1A Rajendra Dashrath Veer, who died on 10.03.2015.

The present Civil Application is filed within time.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) Civil Application is allowed in terms of prayer clause (b) which read thus:

"b) The respondent nos. 1a(i) to 1a(iv) may be taken on record as heirs and legal representatives of deceased Respondent No.1a Rajendra Dashrath Veer." b) Applicant to carry out appropriate amendment in Second Appeal as well as Civil Application within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) If amendment is carried out within stipulated time as stated hereinabove, office is directed to issue notices to the added respondents in pending Civil Applications, returnable after 12 weeks.

d) In addition to usual mode of service, the applicant is permitted to serve the Respondent in pending Civil Applications by way of private notice either by RPAD and/or by hand delivery and to file an Affidavit of service to that effect on or before next date.

e) Civil application stands disposed off accordingly.
