In the light of order dated 14th August 2014 passed by the Assistant Director of Town Planning, Sangli [copy of which is annexed at Exhibit-S page 35 to the petition], Mr. Warunjikar, learned Counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to make an application / representation to the Director of Town Planning, Pune. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is dismissed as such. 2.

In the event such an application / representation is made by the Petitioner to the Director of Town Planning, Pune within the period of four weeks from today, the same shall be decided as expeditiously as possible and preferably within the period of three months from the date of its filing. Such representation / application patilsr 1 / 2

shall be decided independently, on its own merits and in accordance with law. It is made clear that this Court has not gone into merits of the matter and all points and contentions of the respective parties are kept open.
