This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.105/2023 registered with Vijapur Naka Police Station, Solapur for offences punishable under sections 420, 465, 467, 468, 471 of the Indian Penal Code.

Heard learned counsel for the Applicant and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.
The aforesaid crime was registered pursuant to the FIR lodged by Shakuntala Sidram Potdar. The first informant claims that she was in need of money and that she had approached the Applicant for the said purpose. He had agreed to pay the money on a condition that she would execute a nominal sale deed in his favour and further pay interest @ 3%. She claims that she had opened an account in Saraswat Bank in the year 2018. The Applicant had taken 10 cheques and misused the same.

The entire transaction is of the year 2018. The FIR is lodged in the year 2023. The records also reveal that the Applicant has also lodged complaint against the first informant on 04/01/2021, which is prior in point of time.

Considering the above facts and circumstances, this Court by order dated 28/04/2023 had granted interim bail to the Applicant. 2/3
Learned APP states that pursuant to the said order, the Applicant has reported to the Investigating Officer and that he has been interrogated. Learned APP, under instructions from the Investigating Officer, states that investigation is completed and the presence of the Applicant is not required for the purpose of custodial interrogation. The Applicant is a permanent resident of the State. There are no chances of the Applicant absconding or thwarting the course of justice. Hence, the interim bail granted by this Court vide order dated 28/04/2023, stands confirmed. 6.
Application for Anticipatory Bail along with Interim Application stands disposed of in above terms.
