I have perused the order dated 13th May, 2022 passed by this Court. In terms of that order, the applicant has reported to the Investigating Officer and co-operated in the investigation. The material on record, prima-facie,

Rane 2/3 18-ABA-1319-2022.odt indicates that civil proceedings are pending between the parties and alleged offences have the genesis in the said dispute. The applicant is a practising Advocate and has firm roots in the Society. Thus, in consideration of the facts of the case and the accusations, in my view, custodial interrogation of the applicant in Crime No.341/2022 registered with Shahupuri Police Station for the offences punishable under Sections 454, 457, 380, 447, 341 and 506 of the Indian Penal Code, is not required. In that view of the matter, the application is allowed.

In the event of arrest of the applicant in Crime No.341/2022 registered with Shahupuri Police Station, he shall be released on bail on executing P.R. Bond in the sum of Rs.25,000/- (Rs. Twenty Five Thousand only) with one or more local sureties in the like amount.

The applicant shall join the investigation as and when called.

The Applicant shall furnish his residential address as well as permanent address and contact details to the investigating officer within a week;

Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Application is allowed and disposed of accordingly. 8.

It is made clear that observations made hereinabove be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way influence the trial in other proceedings.
