The criminal appeal is of the year 2021. Considering the pendency, it is unlikely that the appeal will be heard finally soon. The applicant/ original accused No.1 has filed this application for suspension of sentence and for releasing the applicant on bail. It is alleged that on 30th August, 2015, at 7.00 pm, the present applicant along with his son Harshawardhan, a child in conflict with law in furtherance of their common intention, committed the murder of Suresh Jadhav by the weapons like sword and Kukari. Prosecution has alleged that accused No.1's wife

904-ia-1468-2025.doc had an extra marital affair with deceased.

Learned APP opposed the application contending that there are three eye witnesses and further invited our attention to the findings recorded by the Trial Court. However, considering that the applicant is in custody for more 10 years, and the present appeal is not likely to be heard immediately, we are inclined to suspend the sentence and release the applicant on bail. Hence the following order:

The sentence imposed by the Trial Court by the order dated 24th April, 2021 in Sessions Case No.8 of 2016 is suspended. 4.

Applicant is directed to be released on bail on his furnishing P. R. bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

Applicant shall furnish his address and contact details to the Trial Court.

6.

The applicant shall attend the hearing when this appeal is listed for final hearing.

The application is disposed of.
