IN THE HIGH COURT OF JUDICATURE AT BOMBAY

Dipak Dhananjay Dhanawade & Ors.
..Respondents .....
Mr. S. R. Page, Advocate for the Petitioner.
Mr. N. Y. Chavan, Advocate for Respondent Nos.1 to 4. CORAM : C.V. BHADANG, J.
DATE : 08th JANUARY 2020 P.C.
.
Heard learned counsel for the parties.
2.
The challenge in this petition is to the order, by which about 21 change reports, have been remitted back to the Assistant Charity Commissioner, Sangli by an order dated 29/10/2015. 3.
On hearing learned counsel for the parties, I see no reason to interfere with the order as the petitioner shall get an opportunity to contest the change reports. Learned counsel for the petitioner submitted that the change reports accepted earlier have been objected to after long period of time and therefore one of the grounds of challenge is delay and latches in challenging the change reports. Needless to mention that all such grounds as are available in law and facts, can be raised by the petitioner before Assistant Mamta Kale
2 /2 42-wp-6291-18 Charity Commissioner and the Assistant Charity Commissioner shall consider the same while deciding the change reports. Thus, keeping the rival contentions open, the petition is disposed of with no order as to costs.
3.
The Assistant Charity Commissioner shall decide the change reports as expeditiously as possible.
4.
Parties to co-operate for the expeditious disposal of the change reports.
