On 8th January 2024, Ms. Shaba Khan, learned advocate appeared for the Petitioner and sought three days time to inform the Court as to whether the cause of action to the petition is survived. Accordingly, this Court granted time.

Today when the matter is called out, Mr. Govilkar, learned counsel appears for the Petitioner and states that despite many attempts he was unable to contact the Petitioner and he has no instructions.

The Petition is, thus, dismissed as infructuous. 5.

However, if the Petitioner feels that some cause of action since survives, it is at liberty to take steps to revive the petition in accordance with law.
