CORAM : SMT. SADHANA S. JADHAV,J.

DATE : SEPTEMBER 26, 2019.

P. C. :

This is an application seeking relaxation of condition imposed upon the applicant while granting bail on 24/2/2018. Learned Counsel submits that the party of the complainant and principle accused have come to terms politically and therefore, the conditions be relaxed. Change of Political Equations cannot be a good ground to flout the orders of the Court, nay, for relaxation of conditions. Learned Counsel for the applicants seeks liberty to withdraw the application after it was brought to the notice of the learned Counsel that conditions imposed by this Court vide Talwalkar

902.appp564.18.doc order dated 24/2/2018 were flouted within no time in utter disregard to the orders of the High Court and today an application is being made only as a farce to show that the conditions are relaxed. The breach of order ought to have been brought to the notice of this Court by the State. However, the same has not been done for ulterior purpose. It is a sorry state of affairs that the police did not seek cancellation of bail, for reasons best known to the department.

Be that as it may, without passing any coercive orders, liberty to withdraw is granted. However, the investigating agency shall take note of this order. The criminal application stands dismissed as withdrawn and disposed of accordingly. Copy of order be sent to the Superintendent of Police, Satara by the Registry of this Court. [SMT. SADHANA S.
