Applicants are apprehending his arrest in C.R. No. 86 of 2025 registered with Sangli City Police Station, District: Sangli for offences punishable under Sections 119(1), 140(3), 3(5) of Bhartiya Nyaya Sanhita, 2023.

It is the prosecution's case that on 22nd February 2025 around 6.00 p.m., applicant and co-accused kidnapped the first

informant in the car by pointing pistol at him and detained him in one room and assaulted him with wooden rod and pistol and took out his motorcycle.

It is contention of learned counsel for applicants that applicants are falsely implicated While on interim relief, they have cooperated in the investigation. Investigation is almost completed. The first informant owes Rs. 1 Crore 60 Lakhs to the applicants. To avoid payment of the said amount, false complaint is filed against the applicants. Hence, requested to allow the application. 4.

It is contention of learned APP that mobile tower location of the applicants shows presence of the applicants at the spot of the incident. The applicants and co-accused kidnapped the first informant and assaulted him. Considering the allegations against the applicants, their custodial interrogation is required and requested to reject the application.

I have heard both learned counsels, perused F.I.R. and documents produced on record. The applicants are on interim relief for around 10 months. They have cooperated in the investigation. Investigation is almost completed. Considering the allegations against the applicants, their custodial interrogation is not required and I pass

following order:

O R D E R

I.

Applications are allowed.

II.

In the event of arrest, applicants be enlarged on bail in C.R. No. 86 of 2025 registered with Sangli City Police Station, District: Sangli on furnishing P.R. Bond in the sum of Rs. 20,000/- each with one or two sureties in the like amount.

III.

The applicants shall attend the concerned police station as and when required.

IV.

The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

V.

Applications are disposed off in above terms. VI.
