The only reason given for seeking condonation of delay is that, the applicant, after the order of acquittal, was advised to file an appeal in the District court. According to him, he later on learnt that the appeal was required to be filed in this avk 1/2

18-APPLN-297-2015.doc court. However, admittedly, no appeal was filed even in the District court i.e. the court of Sessions. As such, I am unable to hold that any sufficient cause for condonation of delay has been shown by the applicant.

The application is rejected.
