Heard learned counsel for the Applicant and learned APP for the Respondent-State.

The learned counsel for the Applicant submits that, the Applicant has convicted for the offence punishable under Section 7 of the Prevention of Corruption Act, 1988 ('PC Act' for short) to suffer two years rigorous imprisonment and pay fine of Rs.1,000/- in default to suffer further RI for one month. The Applicant is convicted for the offences punishable under Section N.S. Kamble page 1 of 3
13(1)(d) read with Section 13(2) of PC Act to suffer three years rigorous imprisonment and pay fine of Rs.2,000/- in default and to suffer further RI for two months.

The learned Trial Court has suspended the sentence for the Appeal period. During the Appeal period Applicant is on interim bail and requested for continuation of the said order. 4.
The learned APP submits that appropriate order be passed.

Considering the submission of both learned counsel as well as sentence imposed on the Applicant is short term sentence. During trial Applicant was on bail. He has not misused the liberty. Considering these facts, the sentence is suspended till final disposal of the Appeal and I pass following order.
ORDER
(i) The substantive sentence of imprisonment awarded to the applicant is hereby suspended pending disposal of the appeal, subject to the applicant furnishing a PR bond in the sum of N.S. Kamble page 2 of 3
Rs.15,000/- with one or two sureties in the like amount.
(ii) The bail bonds to be furnished before the learned Special Judge/Sessions Judge.
(iii) The Criminal Application is disposed of.
