The petition challenges the judgment dated 26th February, 2019 passed by the Co-operative Appellate Court to the extent that the Cooperative Appellate Court has remanded the matter to the Trial Court subject to the payment of Rs.2 lakhs by the petitioner to the Society. 2.

By order dated 3rd May, 2019, this Court had stayed the direction in the impugned order subject to the petitioners depositing before the Co-operative Court sum of Rs.1 lakh on or before the next date.

Office records indicates that there is non compliance of the rsk 1 of

Learned counsel for the petitioner fairly concedes that there is non compliance of the order of 3rd May, 2019. 5.

As there is non compliance of the order passed by this Court, I am not inclined to consider the petition on merits. Petition stands dismissed.
