These applications, under Section 438 of the Cr.P.C., are filed by the aforesaid Applicants seeking pre-arrest bail in Crime No.25 of 2020 registered with Devgad Police Station for offences punishable under Sections 419, 420 r/w 34 of the IPC.

Heard Mr. Niranjan Mundargi, learned Counsel for the Applicants and Mr. S.H. Yadav, learned APP for the Respondent State. I have perused the records and considered the submissions advanced by learned Counsel for the respective parties.

The records reveal that the Applicants were granted interim bail on 11 November 2020. Learned APP, under telephonic instructions from Mr. Nilkanth Bagule, P.I., Devgad Police Station, states that the Applicants have co-operated with investigation that the investigation is completed and charge-sheet has been filed in RCC No.34 of 2021 before learned Magistrate, Devgad. In such circumstances, custodial interrogation of the Applicants is not necessitated 4.
Under the circumstances, the applications are allowed on the following terms and conditions:
(i) In the event of arrest of the Applicants in C.R. No.25 of 2020 2 / 3
registered with Devgad Police Station, the Applicants shall be released on bail on furnishing PR bonds in the sum of Rs.25,000/- with one or two sureties to the like amount; (ii) The Applicants are directed to attend the hearings of the Court on all dates.
(iii) The Applicants shall report to the concerned Investigating Officer as and when required by the Investigating Officer; (iv) The Applicants shall not tamper with the prosecution evidence and or influence the witnesses in any manner; (v) The Applicants shall keep the Investigating Officer informed of their current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time. 5.
The applications and the intervention applications stand disposed of.
