Having carefully considered the petition and its annexures as also the statements made in the affidavit-in-reply, we are of the firm view that for that particular Academic Year / Session and bearing in mind the position prevailing therein, a decision was taken not to permit any additional Engineering College whether exclusively for women or otherwise. (915)ASWP13631.18.doc The learned AGP, on instructions, states that now this policy is altered and in the event the petitioner is desirous of setting up an Engineering College exclusively for women, the Government will consider that application without applying any earlier decision or view. It will take a fresh decision on its own merits and in accordance with law.

Since this stand is now reflected from the affidavit-inreply taken on record as also the oral instructions to the learned AGP, we do not think that the petition should be kept pending. The petitioner is free to apply and seek the requisite permission and approvals from the State Government and all statutory authorities so as to enable it to set up an Engineering College exclusively for women. The petitioner's request shall be considered in accordance with law.

The Writ Petition, accordingly, stands disposed of. M.S. KARNIK, J.
