Limited relief sought in the present writ petition is to decide the interim application in a revision application filed by the petitioner, pending before the State Government. 2.

According to the petitioner, the State Government is not deciding the stay application due to existing Model Code of Conduct issued by the Election Commission. However, this Court has already clarified that the Model Code of Conduct shall not be impediment in exercise of quasi judicial power. Hence, the State Government (Respondent No.1) or the Secretary to decide the stay application or the revision in accordance with law as expeditiously as possible.

The petitioner's request for interim relief or final adjudication in the stay application and / or revision shall be decided within four weeks from today.

The writ petition stands disposed of in above terms. No costs.
