The applicant is accused in crime No. 53 of 2017 registered at Miraj Rural Police Station for the offences punishable under Sections 304, 313, 314, 315, 316, 318, 419, 420, 201, 120(B), 176, 109 read with 34 of the Indian Penal Code (I.P.C.) and Sections 33 and 34 of Maharashtra Medical Practitioners Act and Sections 4(B), 5(2), 5(3) and 5(4) of Medical Termination of Pregnancy Act 1971. 2.

This Court by order dated 06/06/2018, granted bail to the present applicant inter-alia on his undertaking that he will not practice as Radiologist or any other field of Medical Science till the conclusion of trial.

The learned counsel for the applicant submits that the trial is still at the stage of charge, and there is no likelihood of conclusion of trial in near future as the applicant is on bail. 4.

Considering the facts and circumstances and as the applicant has not breached the undertaking for a period of more than four years, I am inclined to allow the present application. 5.

The applicant is discharged from his undertaking dated 23/02/2018.
